Terms and Conditions
Simplexity Gaming Servers ("Simplexity Gaming Servers" or "we") believe that you the customer should have the best quality service possible, whilst at the same time having as much freedom to use our service as you wish. We will be doing our very best to provide a quality and reliable service at the best possible price. We can only achieve this with a little help from you, the customer.
To assist us with providing you with the best service possible we must insist on a few basic terms and conditions below.
Terms and Conditions
Duration of contract:
Your service will last for the duration that you have paid for. If you order and pay for a yearly service on the 14th of December 2008, your service will expire on the 14th of December 2009 (unless additional payment is provided to renew the service prior to expiration). We reserve the right to suspend / terminate your service with us should you be found to use your service outside of our '(Un)Acceptable Use' policy section ).
(Un)Acceptable Use Policy: Simplexity Gaming Servers must insist that users do not abuse, or in any way use our services in any of the following manners, or in such a manner which may lead to the degradation in service quality for others:
Users must not:
* Use the service(s) provided by us, to promote or propagate warez or pirated software / music, pornography, or other similar illegal activities.
* Use of our service(s) provided by us, to Spam, Hack, DoS Attacks or any similar activities.
* Do anything that may infringe upon the reputation of Simplexity Gaming Servers.
Abusive Remarks:
Discrimination, racialism, and remarks regarding Simplexity Gaming Servers, Simplexity Gaming Servers staff, clan members, customers, and company sponsors is regarded as an offence, and can lead to suspension or termination of your account and permanent ban on all our systems, you will not have the right to claim a refund or use legal action against us.
Contract Renegotiation:
If Simplexity Gaming Servers receives an unforeseen price increase in our colocation costs and/or circumstances beyond its control that alter the performance of the service we have may have to renegotiate your current contract before your next payment, unfortunately this may result in an increase in your monthly payments.
Service Rates:
The user acknowledges that the nature of the service furnished and the initial rates and charges have been communicated to the user. The user is aware that the Company may prospectively change the specified rates and charges from time to time. Any promotional offers are contingent upon Company achieving and maintaining its cost of service goals including but not limited to rates charged to company by its suppliers.
Indemnity:
The User shall indemnify Simplexity Gaming Servers against any and all claims, damages, actions, liabilities, costs and expenses including reasonable lawyer's fee and expenses arising out of:
The User breaching or its non-observance of these Terms and Conditions; or
Any breach or inaccuracy in any of the User's representation or warranties.
Changing our terms:
Simplexity Gaming Servers reserve the right to change the terms and conditions without prior notice.Failure to follow any term or condition will be grounds for immediate Cancellation. Therefore, it is in your best interest to implement a similar or stricter Terms and conditions or otherwise called Acceptable Terms of use policy.
Payment:
Establishment of this service is dependent upon receipt by the Company of payment of stated charges. Subsequent payments are due on the anniversary date of the month for that month's service. Payment for game server hosting and voice server hosting is due prior to service activation. The Company will make all reasonable efforts to contact the customer with their account information. Payment for all other services, including, but not limited to, web hosting and web design must be recieved by the company prior to work being done.
Payments and Fees: Non reciept of payment on the specified anniversary date will be grounds for immediate termination of service at the company's discretion.
Failure to Pay:
The Company may temporarily deny service or terminate this Agreement upon the failure of the user to pay charges when due. Such termination or denial will not relieve the user of responsibility for the payment of all accrued charges, plus reasonable interest and any collection fees.
Subscriptions and reoccurring payments:
Simplexity Gaming Servers uses a subscription service for some of our payments, please note, that it’s the Users job to cancel this subscription should he/she not wish to carry on the service. Simplexity Gaming Servers will not give refunds under any circumstances should the User forget to cancel.
Refunds:
Once payment has been received for a service hosted by Simplexity Gaming Servers you cannot claim or we cannot give you a refund under any circumstances unless your service has not been installed within 14 days. In the unlikely of this happening a full refund would be issued.
Account Cancellation:
All requests for cancelling accounts must be made via email to (email address) at least 5 days prior to the anniversary date. a.Credit Card Policy: Simplexity Gaming Servers will automatically charge your credit/debit card each month on the anniversary date of your signing up as a customer. You, the customer, must notify us within five (5) days of your anniversary date that you wish to cancel in order for you credit/debit card not to be charged. There is a £10.00 fee for a credit card being declined. We will charge your credit card this amount upon your next billing cycle or cancellation date. b. Paypal policy: We must recieve payment via Paypal, if this is the method selected by the customer, PRIOR to service set up. The customer will not have access to any pay services if payment is not recieved by Simplexity Gaming Servers.
Faults, Downtime and Errors:
The User accepts that there may occasionally be problems with computers and telecommunication systems. Consequently the User accepts that there may be periods of downtime, relating to the Services and/or Web Site, in which the User cannot access these. However, Simplexity Gaming Servers will maintain reasonable effort to minimize these periods. The User accepts that is such cases of downtime, they will have no claim of breach of contract. When possible Simplexity Gaming Servers will notify the User of predicted downtime and/or scheduled downtime for upgrades, updates, etc.

Technical Support: Simplexity Gaming Servers does provide technical support via e-mail and ensures that the server is online and is remotely accessible. Simplexity Gaming Servers does not guarantee that all technical issues can be resolved. Technical assistance will be provided free of charge through the forums.
Miscellaneous Provisions:
You must provide us with, and keep current, good contact information for you. E-mail, fax, and telephone contacts are used, in that order of preference.
Responsibility for Content: You, as Simplexity Gaming Servers customer, are solely responsible for the content stored on and served by your Simplexity Gaming Servers service.
